Dawn Raid Team
The Dawn Raid Team of Kennedy Van der Laan supports companies during dawn raids / company visits by Dutch and European supervisory authorities, including:
- The Authority for Consumers & Markets (ACM)
- The Dutch Data Protection Authority (AP)
- The Dutch Health Care Authority (NZa)
- The Dutch Central Bank (DNB)
- The Authority for Financial Markets (AFM)
- The European Commission (EC)
The above-mentioned supervisory authorities are responsible for the enforcement of several laws, such as the Competition Act (Mw), the General Data Protection Regulation (GDPR), the Health Care Market Regulation Act (Wmg), the Financial Supervision Act (Wft) and the Treaty on the Functioning of the European Union (TFEU).
A dawn raid may happen if there is a suspected breach of the law, and will be used by the supervisory authority to collect information and evidence.
During a dawn raid, a supervisor may, for example, enter the business premises of the company, ask questions, inspect and copy (digital) data, interview people, and seal off areas.
The company and its employees are obliged to cooperate in a dawn raid by the supervisor. It is not allowed to obstruct the dawn raid by refusing access to the building, for example, or by frustrating the company visit in any other way. It is not allowed either to destroy or keep behind any evidence.
The Dawn Raid Team of Kennedy Van der Laan assists companies during dawn raids. We will ensure that:
- the dawn raid runs as smoothly as possible and proper arrangements are made with the supervisor;
- the supervisor does not exceed its powers;
- the company fulfils its obligation to cooperate as well as possible;
- employees of the company are supported, e.g. while they are interviewed or while they meet requests (for information) from the supervisor;
- the company is well-prepared for the next steps in the investigation and for (possible) legal proceedings.
