Lease law
Lease law distinguishes different lease regimes. Housing accommodation, Retail (including shops and hotels), Offices and other business accommodation. It is true that thanks to the so-called ROZ templates the lease agreements for offices, retail and residential properties are highly standardised, but the legal framework differs a lot per lease regime and the voluminous case law is often very casuistic. Making a difference in this area requires experience and knowledge. Our lease law team has this knowledge and experience.
Our expertise
Naturally, we are more than well acquainted with the various legal regimes as well as the model agreements from the Dutch Real Estate Council (ROZ) and any desired additions and exceptions thereto, depending on the position as lessor or tenant. We have also broad experience with mixed agreements, such as franchise and lease. Because we are frequently involved in all kind of lease disputes and publish articles about recent developments, we are continuously working on our specialized knowledge in this area.
What we do
Our daily practice includes drafting and negotiating lease contracts for offices, shops, hotels, restaurants, parking garages and any other commercial premises. We also regularly advise on renovation projects and other recurring questions such as: cancellation and termination of lease agreements, eviction proceedings, defects, subletting, substitution, rent reviews and service costs disputes. We usually find a practical solution for every matter, but we also do not shy away from taking matters to litigation or arbitration.
