The Authority for Consumers and Markets (ACM) recently launched a new online tool: the DSA check. With this tool, providers of websites and apps (for example) can examine what parts of the Digital Services Act (DSA) apply to them.
In February 2024, the DSA entered into effect for all providers of online services that pass on, store or publish content in the EU. The purpose of the new rules is to make the internet safer, more reliable and more predictable for both consumers and companies. The DSA contains several levels of obligations; while some companies will only have to meet minimum obligations, others (e.g. the big platforms) are subject to elaborate rules. The DSA check was prepared for providers of web shops and marketplaces and websites/apps on which users post content themselves. The ACM calls the new DSA rules extensive and new, and considers it necessary to provide explanations about the DSA to different target audiences. According to the ACM, the DSA check can be especially useful for smaller businesses, which often do not have a legal department.
