On Wednesday, 20 January the Dutch government announced additional measures to get the coronavirus under control. One of these measures is the introduction of a curfew. The curfew took effect on 23 January 2021.
Curfew
Since the curfew has become effective, everyone in the Netherlands is obliged to stay inside from 21:00 at night until 04:30 in the morning. Several exceptions apply for persons who have necessary reasons to go outside. Examples are emergencies, having to walk the dog or to see a doctor. Another exception is made for working people. Anyone who is out on the street without a valid reason risks being fined 95 euro.
Consequences for Employees
Employees are not allowed to be outside during the curfew, except if they are obliged by their employer. Employers in all sectors can decide for themselves whether it is necessary for their staff to work during the curfew. This may be the case for meal delivery staff or hospital staff on their way home after an evening shift. However, such employees must carry an ‘Employer's Curfew Statement’ (Werkgeversverklaring avondklok) that was completed by their employer. This statement, which can be downloaded here, must be completed and signed by the employer. Employees should also be able to present the ‘Own Curfew Statement’ (to be downloaded here). Please note that it is not allowed for employers to draft their own statements or forms.
Consequences for Self-Employed Workers
Self-employed workers have not been forgotten. They are also allowed to go out for work during the curfew if they have to. If they do, they too will have to carry an ‘Own Curfew Statement’ as well as an ‘Employer's Curfew Statement’. The self-employed worker must specify the (company) name and contact details of the client in the ‘Employer's Curfew Statement’. If the self-employed person has no client, he should fill in his own (company) name and contact details.
