De technologische ontwikkelingen in de financiële sector, die voor grote veranderingen in het financiële landschap zorgen, roepen complexe juridische vraagstukken op. Het FinTech-team van Kennedy Van der Laan is al jarenlang actief op dit rechtsgebied. Dat is niet verrassend, want technologie zit in het DNA van ons kantoor. Zo waren wij betrokken bij vrijwel alle grote interbancaire samenwerkingen op het gebied van betalingsinnovaties (zoals processing door Equens, iDeal, Mobiel Betalen, eMandates, chartale logistiek van GSN). Door onze ruime expertise hebben wij in al deze dossiers strategisch meegedacht én praktisch geadviseerd.

Op verzoek van de Nederlandse Vereniging van Banken hebben wij een handboek voor banken samengesteld voor de implementatie van de Payment Services Directive (PSD) en meerdere banken daarover geadviseerd. Daarnaast adviseren wij financiële instellingen doorlopend over bestaande en nieuwe regelgeving, zoals bijvoorbeeld Anti-money laundering (AML) regulations, Single Euro Payments Area (SEPA), PSD 1 en PSD 2, Multilateral Interchange Fee (MIF) Verordening, e-Identity en de Privacy Verordening.

Zoals blijkt uit ons trackrecord adviseren wij niet alleen banken en betaaldienstverleners, maar ook FinTech-startups, variërend van P2P lending/equity plaforms tot payment solution providers. Ook hebben wij een aantal toonaangevende lending platforms begeleid bij het vergunningtraject bij de AFM.

In ons FinTech-team zijn verschillende expertisegebieden samengebracht. Vanzelfsprekend maken Regulatory- en IT-specialisten er deel van uit. Ook op het gebied van cruciale onderwerpen als big data en privacy zijn specialisten onderdeel van ons team. Waar samenwerkingen worden aangegaan, spelen vaak mededingingsrechtelijke issues. Dit specialisme is daarom ook vertegenwoordigd. Deze bundeling van expertises maakt ons tot een volwaardige sparring partner op het gebied van FinTech-vraagstukken.
