Mediation

“Not every conflict needs to be resolved in court.”

It is not always necessary that a conflict leads to legal proceedings. In some conflicts mediation may be the appropriate way to arrive at a solution. Mediation is a form of conflict resolution in which an independent neutral third party – the mediator – who takes each party’s interest into account, helps parties find a solution to the conflict that is the best option for all parties. Mediation can be of great value in situations in which the parties have to go on with each other after the conflict. Through mediation a conflict can be resolved behind the screens, making it unnecessary to go to court.

Their experience as lawyers makes the mediators of Kennedy Van der Laan able to get to the bottom of the commercial and individual interests of parties and to make these interests open to discussion at high levels, including a legal level, if necessary.

Individual and collective labour-law matters, disputes between shareholders, conflicts between insurance companies, real property-related issues and disputes in the field of employee co-governance; our mediators are greatly experienced in resolving conflicts constructively in all of these fields.

Our mediators work on the basis of the Rules of Conduct of the MfN.

Kennedy Van der Laan is mentioned in Legal 500 as a Tier 1 firm for mediation.
