Bij het bepalen van strategisch en commercieel beleid hebben ondernemingen in allerlei sectoren te maken met de grenzen van het mededingingsrecht en het Europees recht. Het team Europees en Mededingingsrecht geeft strategische adviezen op directieniveau en adviseert ook rechtstreeks aan de business/sales afdeling van onze cliënten. Wij behandelen vaak complexe, omvangrijke en grensoverschrijdende projecten en geschillen in vele verschillende sectoren en adviseren aan zowel grote multinationals, als nationale cliënten.Het team Mededingingsrecht en Europees recht heeft, naast haar juridische expertise, ook specifieke marktkennis en daarmee inzicht in de werkzaamheden van onze cliënten en de markten waarop zij opereren. Hiermee kunnen wij onze cliënten praktische adviezen geven en commercieel haalbare oplossingen voorstellen. Dankzij onze deskundigheid, praktische werkwijze en jarenlange goede relatie met de toezichthouders zijn wij in staat om mededingingsrechtelijke risico’s voor onze cliënten te beperken en om geschillen met de mededingingsautoriteiten en andere toezichthouders effectief op te lossen.
Procesvoering
Het team Mededingingsrecht en Europees recht heeft ruime ervaring met het vertegenwoordigen van cliënten in procedures voor Nederlandse en Europese mededingingsautoriteiten (zoals de Autoriteit Consument & Markt en de Europese Commissie) en rechterlijke instanties.
Wij hebben specifieke deskundigheid op het gebied van zogenaamde follow-on litigation, zoals kartelschadeclaims. Op het gebied van procesvoering werken wij actief samen met het gespecialiseerde team Procesvoering & Arbitrage van Kennedy Van der Laan.
